CHARTER FLIGHT APPLICATION RULES IN BRAZIL

A foreign company applying to a charter flight to/from Brazil, must have been previously qualified by Brazilian Civil Aviation Authority (DAC) to conduct flights to Brazil under RBHA 129, which is similar of FAR 129 regulation in USA.The application process must be conducted by a representative in Brazil, a Brazilian citizen, vested through a POA from the applicant airline, in its original form, legalized and notarized. It takes usually ten working days to conclude such a process.

The process shall be also supported by the following documentation, to be initially presented by FAX copy:

  1. Power of Attorney;
  2. Airline Certificate at the original country;
  3. Insurance Policy for the whole fleet;
  4. List of aircraft: registration and airworthiness certificates.
  5. List of flight crew with respective license numbers

There's a model for the POA, as recommended by DAC, that must be sent signed in the original form, legalized and notarized through courier, in not later than 10 working days after having it presented by FAX.

Before apply to DAC for each flight authorization, the local representative must assure the airports clearance to receive the flight, which is a mandatory item on the flight approval process. It takes usually one day.

It is also necessary a copy of the MAWB on the incoming flight, at least two hours before the take off from the origin airport, in order to start the necessary consignment process with Brazilian customs. This a mandatory procedure, under the airline's responsibility, and, if not well conducted, it can affect the consignee's clearance process.

Brazilian Civil Aviation Department - DAC, usually requests 2 full working days to process a cargo charter flight application and 5 days for a passenger one. Any application in less than this time would be charged a late request fee (US$ 4,293.00), to be eventually authorized on a waiver basis.

Brazilian Government doesn't grant any cabotage, and 5th freedom rights, except under waiver conditions and solely at DAC discretion. In the case of the US companies, the bilateral agreement between that country and Brazil has a pre-approved annual quota of 700 cargo and 450 passenger flights, with 4th freedom rights included.

However, before start the operations, an US airline must present a document from DOT with its designation to conduct non-scheduled flights to/from Brazil. And besides it, every flight application must be preceded by a Notice of Consistency from the US Government (DOT) addressed to Brazilian Government (DAC).

In case of cargo flights destined to Brazilian airports, there's also an airport supervision fee, which includes cargo consignment procedures, crew immigration and hotel/transportation reservations.
